capital resolve trying to claim for Bank Smart

Hi,
I've recieved a letter today from capital resolve, demanding payment of £145 for their client Bank Smart

I last dealt with bank smart in 2008 when i told them i would not be using their services, can they still chase this money?

Also the letter Capital Resolve sent me had to be replied to no later than the 18th of March but I didn't receive it till the 19th

What should I do?

What was the agreement with Bank Smart, would there have been outstanding charges at the time you stopped dealing with them/

I contacted bank smart to claim back bank charges but after they asked for 5 years of bank statements i told them I wasn't going to go ahead and told them not to bother, this is the first time in 7 years I've heard from them

Make a formal complaint and if they don't back down within 8 weeks you can take the complaint to the Legal Ombudsman.

The debt is statute barred after 6 years with no payments or written acknowledgment so tell 'em to NAFF ORF as you wont be paying!!

I checked My spam email account earlier and noticed they had sent an email, so I replied saying it was over 6 years old and I want to make a formal complaint, see if they bother replying now

It occurred to me that the FSA imposed a waiver on all bank charges complaints in July 2007 until November 2009 when the Supreme Court effectively ruled that banks charges couldn't be reclaimed. So if you signed up with Bank Smart after July 2007 they were not capable of providing you with the service of reclaiming bank charges in any event.

Check credit reference files just in case BS has left a marker. ( try Noddle it's free online)
