    Hi,

    I'm new this forum so you may have to bare with me. This I a very complicated one so any advice would be appreciated. To cut a very long story I have recently received a notice from a debt collection agency (Icon Collections) threatening Court Summons if £373 is not paid immediately. This issue has been passed to Icon by Premium Choice (Car Insurance provider) who I had a policy with from July 2012 to June 1013. I first received correspondence on the matter from Premium choice in August 2014, some 14 months after my policy had ended which had been paid in full on time. Without going in to all the detail an indemnity claim was made in error by my bank (Barclays) which they accept, for the last 6 months of my cover during the period of 2012/13. The money at the time was refunded to my Bills account not my Current account and for this reason I was not aware of any discrepancy. The bank have accepted there error however state that I am liable for the funds for which premium choice are chasing. I feel this is unfair as I paid my cover in monthly instalments in full and on time and through no fault of my own I am caught between Barclays and Premium choice.

    My frustrations lie in the fact that Barclays obviously made a huge error and secondly in the fact that Premium Choice only alerted me to the matter some 14 months after the event, when if they had informed my at the time the issue would have been resolved immediately. The money is no longer in my bill accounts as my usual course of action each year is use whatever "float" I have in the account towards the end of the year on Xmas presents etc. It was of course an oversight on my part that I did not notice the transaction within my bills account when the money was refunded but by definition my bills account is constantly changing and I do not regularly check this account. In any case we are where we are.

    Any advice on the best course of action with regard to the debt collection agency would be appreciated, I truly believe that I should not be liable for these funds and that this is an issue for Premium choice to resolve with Barclays. I have kept in communication to Premium choice to this effect. Having done some research, under the terms of the Direct Debit Guarantee Premium choice as the Direct Debit Originator at the time of the event could have reclaimed the funds back from the bank within 14 days however did not take this course of action and instead left it 14 months to contact me about the matter requesting I pay the funds, something I feel is unfair.

    I could have gone into much more detail as this is not as cut and dry as it may appear but I think I've taken up enough space so any response would be appreciated.
