  • DCAs and Defaults ?

    If a default drops off your credit report after 6 years whether it's paid or unpaid, can the DCA apply for a CCJ on the spent debt, therefore starting the 6 year period again ? Thanks for any help

    Yes they can, assuming not statute barred at that point.

    A CCJ would not be a new default. It would be a entry in the public record section of your report instead. Although a CCJ that is then paid in full within one calendar month of being granted will not go on your credit files.

      A debt being removed from credit files does not mean it is statute barred any payment or acknowledgment to the debt in the relevant 6 year period restarts the clock.
      SB = 6 clear years no payment or unequivocal written acknowledgment in 6 clear years. Also any Count Court Claim stops the clock on the date of issue.
      SB and removal from CRA files have no relation.
