    Hi

    I am seeking some information before a DCA does a dirty on me from behind.

    Original Creditor was Bank of Scotland with whom I had to threaten them with a report to the ICO as they continually failed to update my new address.

    The debt £10k plus and my Credit Report states that a Leeds DCA are the owners, but, I also note that the address they have supplied to the DCA is my old address although I have proof of the original creditor having my new address

    I have not received any notice of the debt being sold but the new owners are well known for being over zealous with CCJ's and Bankruptcies

    I have been expat in SE Asia two years and the country I live in has no reciprocal agreements with the UK concerning individual debt

    Where I now live I am unable to own property as I am not a national of the country but I have to hold a UK bank account for my pension payments.

    My question is can the debt be sold to or enforced in the county I now reside or what is the worste than can happen in this case

    do you intend to come back to UK in the future? take it you are in the Phillipines??? the info may help others to access situation overall?

      Currently the answer is no (I am retired). but ... wife says that when step kids have finished school and got jobs would maybe like to settle in UK. That would be in about 6 - 7 years

      PS ... how did you guess where I was.

        My 2nd home, few mentions within your thread sounded familiar where you were & local regulations on property etc.

          Correct Mike770, Legazpi City, Albay. Wife was born in Iloilo and resided many years in Tabaco City, Albay.

          Would recommend anyone to visit this country, not expensive and rebuilding.

          So I don't really have too much to worry about, just that I don't want this Leeds DCA (Lowells) obtaining a Bankruptcy and finding that they can enforce here.

            My O.H. from Bicol region as well.


            Best to give full information on here i.e. debt details with whom, , last payment, outstanding balance? also lowells may try to under old address as no defence really as you would have not informed them, sure Ame may be able to advise on here PM her>

              Lowell can do nothing even if they get a judgement, and if you don't intend to return to the UK for 6+ years then this will be off your credit files anyway.
              BR in this case would achieve nothing for Lowell, you have no realisable assets to be considered.

                The common law: If none of the above regimes applies, there is no way of directly enforcing an England and Wales judgement abroad. The national or state law of the country or state in which you wish to enforce the judgement will apply. You will usually have to start new legal proceedings to obtain a judgement in that jurisdiction, for example in the USA. You should seek advice from foreign lawyers on this process.

                  Thanks for the info. I am in the Philippines, there are no individual reciprocal arrangements for debt so I would be safe in that respect. A friend here is a Senior Lawyer so I would have good representation. I made the query as i noted from another website (not sure but I think Moneysupermarket / Moneysavingexpert) that a Bankruptcy could be enforced anywhere in the world for three years from obtaining it.

                  As this debt is left from a very bad relationship breakdown ny wife does not know, and never will know the full extent of the damage caused to me financially or the hatred from that relationship and the cause of it (I was at one stage I was 4,000 in debt with mortgage and other debt of almost 26,000

                    Reason cfor the debts are a very bad relationship breakdown. My ex was using my cards and hiding the statements but I was still paying what I thought was a little over the required amount. It soon transpired that even my mortgage payments were overdue by just over £4,500. I decided to sell quickly and get out of the country and got married to my gorgeous wife in July 2013.

                    Tried both ways of recovery from my ex but as she had no assets (apart from her mouth) I could not recover, the police say that legally, as I let her use my cards it was my responsibility which unfortunately I accept.

                    Last payments against all were June/July 2013 ... Where there are brackets this indicates the original creditor before being sold

                    Lowells (HSPF) £12,000
                    Lowells (J D Williams) £ 170
                    BOS Visa £ 1,200
                    Santander Overdraft £ 1,100
                    Santander Overdraft £ 950
                    Santander Credit Card £ 1.800
                    CallQuest (Marbles) £ 2,950
                    Stake Your Claim £ 450
                    British Telecom £ 180

                    Lowells (ex HSPF) I have not received any notice of the sale of the debt even though HSPF have my new address. It has been passed on to Lowells without any amendment to my address which I have proof that HSPF have via credit reports. However, Lowells have my address from a second account (see below)

                    Lowells (JD Williams) Once I won the claim for PPI against JD Williams I have a email from Lowells stating that they are not chasing this amount but nothing saying that they will not sell it on

                    Bank of Scotland Visa. I have no clue to where this is, not on Credit File

                    Santander Bank Overdrafts and Credit Card still with Santander. Claim for £3,000 plus of charges rejected. I have to send this through the Ombudsman as I would not be able to return to the UK if Santander turned up in court

                    CallQuest (Marbles). CallQuest unable to provide a CCA since September 2011, still chase once a year though

                    Stake your claim. PPI Refunds via Step Change. Informed them that as I no longer reside in UK and have four step children to look after they will have to wait for thier money if they get it at all.

                    British Telecom. Refuse to pay this as I had an idiot turn up at the door saying he was a Bailiff. Had police involved but they onlt gave him a caution for fraudulantly stating powersa he never had. Police tried on many occassions telling me it was a civil matter but i kept on.

                      Thankyou for that:- a mix bag of info, para 7 relevant to lowells and 6 year comment,
                      see what others say regards the other companies, but as you have no assets cannot see that many will go too far, but keep an eye on any events and let them know on here??

                        Haha I just got married in Legazpi, been there so many times.
                        I'd be absolutely amazed if it's enforceable there, they would have to personally come and bribe someone.
