  • Fredrickson International Ltd / FPC Letters

    My OH received a 'Confirmed Resident' letter from FPC before christmas in respect of an outstanding debt but no details, asking for payment ?

    I told her to ignore it, in which she did but now she is continuously receiving further letters, this time with a balance outstanding on a debt with Capital One, that she vaguely remembers but not sure how long ago.

    Does she just ignore them or should she now send the standard DCA letter not acknowledging the debt and requesting the original CCA agreement / Notice of assignment details etc ?

    If letter to be sent please can someone kindly advise which one would be suitable as I see there are variations.

    Hi Bazza,
    A quick check on credit files would give a basis for planning to challenge this.

    Yes CCA request to Freds

    For a credit card it's a section 78 request for the agreement and a current statement of the account, that's all a CCA request can be used for.
    The " prove it" letter can be used to ask for the other documents.

      I will get her to do that and send a CCA request.

      What about notice of assignment - would that be a later request ?

        Ask for the NOA in the prove it letter. IF one of the letters already received in not the NOA.

          Cheers again Nem and will ask her to send CCA first.

          Also how can you be certain if the debt has been sold ?

            I can't remember a fraudulent assignment ever happening in a consumer credit debt sale Bazza it's probably the only part of the debt purchase industry that is reliable.

            Of course mistakes can be made but that is relatively rare I think.

            The system of NOA's where either the original creditor and or the debt purchaser confuses matters when of the 2 NOA's are sent in the same envelope or on the creditors letter head but sent by the debt purchaser.
