    Hello everyone I'm new to the site and in need of advice regarding my council tax debt and has been passed on to rundles bailiffs.

    They visited me about 6months ago to try and resolve a payment plan. My wife has allowed entry to the premises and signed for a walking possession order on 2 items my old car which was now sold and replaced with a different one and a Tele.I been paying 50 pounds weekly but this month because of change of jobs I then only get paid monthly and have no money to pay the bailiff at all so he drop a letter saying (attendance notice advice of taking control of goods) on my post box stating the date he will come back. My biggest problem is we live with my wife's brother as a tenant and he has not got any receipt for his stuff. Are they allowed to take more than what's on the levy? He had a recorder with him on his first visit before my brother in law moved in with us so in the video none of my brother in laws item is seen. What can they do and what can they take.

    I have no plans on paying them but I'm scared that they can just take the levied goods and more as the debt is still around 1200 pounds. I am currently waiting for my pay check as well to pay for a debt relief order application to go through. Any ideas would be of great help please. Thank you

    Two things you have done wrong. Firstly, you were not permitted to sell the car. Technically, it wasn't yours to sell. Secondly, you should have told Rundles about the change.

    The best thing to do now is to write to Rundles and copy the council in. Explain what happened with the job change and that you now need to pay on a monthly basis. You do not wish to incurr further charges and see no need for this account to enter the sale stage. If an AOE was in place, no money would have been taken from you, as there were no earnings to take it from.

      You most certainly need a plan to pay the bailiff this is Not going to go away!!
      Selling the car is I think going to cause problems how bigger problem depends on the bailiff.

        Thank you for your reply . I have notified them about the change of car due to somebody crashing into it. The problem I'm having is I need to not pay rundles for at least 8 weeks for the debt relief order to go through. My biggest worry is are they allowed to take more than what's levied? There's no AOE the bailiff has my card details and tries to deduct every Friday. Thanks

          I would phone your bank up asap and report your card lost. The last thing you want is the bailiff having the details as he will keep trying to get all the back dated arrears as soon as any money goes in. With a new card, the details that he has will be cancelled.

          There is no guaranteed way of stopping the bailiffs for 8 weeks. You could try writing to them but its doubtful they will listen, as council tax is a priority debt.

          They cannot take more than what is listed on the agreement that your wife signed. The problem you have is that if they do come to take goods, it will add more fees to your debt.

            Please do not lie about losing the debit card.
            All you have to do is tell your bank the card is compromised and
            unauthorised payments may be taken from it.

                  The card is not compromised so to say so would also be a lie.

                  The debtor needs the card stopped asap, not 3 weeks next Thursday. I'll leave it to him to decide how he thinks best to stop it.

                    The card is compromised as the payments that may be taken are unauthorised.

                      But the debtor has authorised the payments. An agreed payment plan is in place.

                        Having just spoken to a close friend (banker) she tells me neither remedy is likely to
                        stop and further payments as the card will still link to the same account.

                        This appears to me to be a sensible answer.

                          Just like you, she is wrong. It is the card details that the bailiff has (16 digit number), not the account number. Once the card is cancelled, the bailiff will be powerless to take further funds out. That is the whole idea behind reporting them lost or stolen. No more debits can be made from a cancelled card.

                            I don't wish to keep correcting you but the 16 digit card number allows access to the account on which the card is issued.

                              You are not correcting me-You are just showing your ignorance.

                              If you don't understand the reason for 24 hour manned "lost card" helplines, it is pointless trying to tell you otherwise.

                              Call me old fashioned, but I always thought that if you phoned and reported a card lost or stolen, it would be blocked there & then and the owner would be unable to use it, even if the card was found at a later date. Try it with your own card of you don't think it works.

                              I report my card lost, at least once a year. Having being caught out by someone taking money out, after me previously giving them my card details, I always get a new card, immediately after passing someone my card details. This means I don't have something come back and bite me on the bum, at a later date. If I have to tell them that the card is lost, then so be it-Much more preferable than money exiting my account that I hadn't authorised.
