  • 1st Credit getting more aggressive

    Now they are getting more aggressive at Reigate. Please see the attached letter.

    I replied to their previous letter with the following:

    "15 December 2014

    Dear Mr Flynn

    Your reference: xxxxxx
    Account number: xxxx xxxx
    Your client means: Marks & Spencer Financial Services plc
    My reference: Mayhew 1b

    Thank you for your letter dated 9 December 2014. The alleged account is currently in serious dispute due to following reasons:

    I requested a copy of my Consumer Credit Agreement, pursuant to s.77-79 of the Consumer Credit Act 1974 (CCA1974) on 3 July 2012 for the above MasterCard account. I subsequently received an application form for a store card account number xxxx along with some largely illegible terms and conditions. I subsequently re-requested my Consumer Credit Agreement pursuant to s.77-79 of the Consumer Credit Act 1974 (CCA1974) on 19 October 2012. Again, I received an application form for the store card number along with some largely illegible terms and conditions.

    I was seeking a true copy of a Consumer Credit Agreement relating to the MasterCard account number xxxx as referred to in my original and follow-up requests. However, I have no recollection of having provided with the appropriate new agreement for this product at the time. As your client may be aware, a new agreement would have been required under section 61 of the Consumer Credit Act 1974 as was proven in the case of Santander vs. Mayhew in the Clerkenwell and Shoreditch County Court on 8 March 2012. Therefore, I suggest that you return the alleged account to your client.

    Please note that I will only communicate with you in writing and will not discuss the matter on the telephone with you or your representatives.

    Any advice please how I should respond now?

    They are considering issuing county court proceedings.

    Well they at this point they may also be "considering":

    • Having liver and bacon for dinner.
    • Emigrating their entire staff to North Korea
    • The meaning of life
    • Whether the moon landings were faked
    • Whether to crawl back under their rocks and go away.
    • etc etc etc......

      Perhaps you could point out to the North Koreans that 1st Creeeeedit could have a copy of 'The Interview' tucked away somewhere in their company server... You could make Kim Jong Un a VIP member for services rendered afterwards...:santa_cheesy:

        It has always been a failing of 1st Crudite from the time Mr N Nathoo was the boss the various desk jockeys at Reigate with their self important titles cannot communicate with each other even of the simplest matters.
        Send a copy of the letter and your letter straight back to them.

        Addressed to Eddie Nott CEO 1st Credit Marked Private & Confidential ( Personal).

        Don't use any of the various PO Box No's they like to use as it wont be signed for.

          So whats the address to use that they actually bother with? I keep pointing out to them I don't owe the amount they want.. Well I don't. OPUS held up its hands, apologised for miss-selling PPI and admitted the bloody sum was just that (before New Day sold it on anyway)

            The Reigate Address without the PO Box number.
            With companies like 1st Credit it is always best to cut out customer (dis) service departments from any complaint or dispute. The staff have little or no authority other than the company script and the good old " computer says NO" reply.

                I received letters from these people back in the summer about my loan I had with HSBC. They sent a letter every week, each letter an attempt to pile on the pressure. I sent them a CPR and CCA letter and received a letter giving the usual rubbish about how they aim to work with people according to the law bla bla bla.. I haven't received anything from them since..

                I used to deliver to their building when I had a round in Reigate. I thought they actually lent money at the time, I didn't know they were a collector.

                  I keep pointing out the fact that I don't actually owe the money they are claiming for and they keep sending it off to some kind of complaint department? The response is postmarked cornwall? Is that some branch or do they have a corporate holiday pad down there???

                    I dug a bit deeper and discovered that Mr Nott was one of the guys behind M&S &more mastercard!

                    Surely, as M&S Money (now M&S Bank) = HSBC got told of by the OFT he is fully aware of his creation's unenforceability?

                        This is interesting:

                        "(8) However, where a firm is aware that an agreement is unenforceable because of non-compliance with an information request under section 77, 78 or 79 of the CCA, a firm should make it clear when communicating to a customer about a debt that the debt is in fact unenforceable. Failure to do so, in that case, would in the FCA's view unfairly mislead the customer by omission. Any communication that implies expressly or otherwise that a debt is enforceable when it is known that it is not, would be misleading. One way to avoid this would be for the firm to explain to the customer the full meaning of 'unenforceable"

                        Surely, M&S Bank know that their 'upgraded store to credit cards' are unenforceable as per Santander vs Mayhew, yet they claim they 'believe' it's enforceable!

                        Next time I might as well send them a Mayhew alertmasroll:
