  • can i ask for proof of assignment

    Hi
I am new to the site so I appologise if I have gone about this wrong

I have been paying a debt collecting company , on a monthly basis, for a debt I originaly thought I had paid off, but unfortunately cannot find the proof to confirm this.
recently I asked the debt collecting company for proof they own this debt, as it seems strange I had not recieved any letters from the original company saying what their intentions where
I was told they do not need to give me this because of a CCJ against me, again I have only their word for this, as I wasn't aware of having a CCj.

I know you must be thinking why pay them anything if you think you have paid them off, It was because they where constantly ringing my telephone demanding money so to get a bit of peace, I started to pay thinking I would find the proof of payment and then could sort it out, from there.

I would be grateful if anyone has any idea what I should do next

    Hi and welcome

Your first step should be to find out if there really is a CCJ against you, which you can do for a small fee, here: http://www.trustonline.org.uk/search-yourself

First of all, find out if there's a CCJ and all the details, when it was recorded, by who, etc.

To record a CCJ the creditor should have issued a claim and you should have received the court papers. If you didn't receive them and the debt was paid off or you have any other argument to dispute it, you could apply to have the judgment set aside.
