    Hi everybody,

    I need some advice on an issue with Jacob's bailiff's, I used to live in a flat a year ago and moved from this address (June 2013) , I contacted the local council (Cheshire West and Chester council) and informed them I would be moving out, they told me that I would need to pay £79 pounds for the last month and the council tax account would be closed which I did. I received a letter at my new address from Cheshire West and Chester council on the 5 of August 2013 stating I still owed them £79. When I contacted them to query this, I was told that it is was an automatic letter sent out that hadn't taken into account that I had already paid. so I thought no more about it. After 6 months I moved again back to my parents as they are elderly and requirde my help.

    After a few months at my parents I received a voicemail on my phone stating I needed to contact Jacob's to prevent further action!, confused at this I called them to see what this was about and made the mistake of giving them my parents address, as it happens they where trying to collect unpaid council tax to the tune of £576!. I explained to them that I had paid my council tax and nothing was owed, they told me I would need to contact Cheshire West and Chester council for more details. After contacting Cheshire West and Chester I found out that my old landlord (Dane plus housing) had contacted them and informed them that I was still living there even though I had informed Dane Plus housing that I had vacated the flat!. As a result of this, council tax charges had continued to be charged!. They said they had attempted to contact me about this matter by letter, I asked where the letter(s) had been sent to be told to my old flat even though I had informed both organisations that I had moved!. So as a result, these supposed council tax charges had been passed to Jacob's to be collected. As I result of this, I agreed to pay Cheshire West and Chester the supposed amount whilst I sorted this out as Jacob's were calling my parents phone threatening removal of property and court action, and of course, I did not want my parents worrying about this (the money was paid directly to Cheshire Wet and Chester council). Eventually after many hours on the phone to both Dane plus housing, Jacob's and Cheshire West and Chester council, I got Dane plus housing to admit that they had given Cheshire West and Chester council the incorrect date I moved out. The result of which was I was sent a cheque by Cheshire West and Chester council as they actually owed me money!, on the covering letter with the cheque I noted a charge for court costs for £75 (apparently Jacob's bailiffs charges!), I called Cheshire West and Chester council for an explanation, I was told that I still owed them £79 and hadn't paid hence why it had been sent to Jacob's and supposedly to court!, I explained to the advisor at the council that I had received a letter for this amount back in August 13 for this amount and queried it as I had already paid this amount and was told it was an overlap between me paying and the letter being generated automatically, the advisor was stoic that this wasn't true (although I have all the notes to support this), at this point, I was completely fed up and at my wits end with this and decided to for go the £75 just to be rid of the situation. I thought that this was the end of it, anyway on the 13 of November 2014, I received a letter from Jacob's stating I still owed Chester West and Chester council £243.74 for unpaid council tax, I ignored this letter as I thought, again it must be an oversight, I have now received another letter dated 24/11/14 that if I do not pay this amount, they will seeking an order to send me to prison!, I called Jacob's and spoke to one rude and horrible woman who informed me that this amount was Jacob's charges even though the letters state it is still owed to Cheshire West and Chester council for unpaid council tax!, I informed this woman that I did not owe council tax in the first place and this should never have been sent to them!!, needless to say I got no joy from them and was threatened with further action if I did not pay this amount in 7 days, of course I told them no. I then contacted Cheshire West and Cheshire council to find out what the hell was going on, I got the same treatment, they stated that these were Jacob's charges for the recovery of the debt of council tax which was £79 that I was told back in August was a result of an automatic letter being sent out to which I had already paid before the letter had arrived and I would have to provide evidence that I had called up to query it!!!. So basically due to Dane housing making a mistake in informing Cheshire West and Chester council of the date I moved form the flat, and Chester West and Chester council informing me that no money's were owed and the council tax account was closed and the letter was an oversight, I now have Jacob's demanding I pay their fee's or I will be sent to prison, even though their letters still state I owe Cheshire West and Chester Council, council tax not their fee's!!!!.

    I could really do with some advice and help with this, as its starting to affect my mental health.

      I think it would be a good idea if you got in touch with the Leader of the Council and their opposite number and asked them to give the Revenue staff a swift kick in the pants. Once the error became evident, the council should have realised the Liability Order had been obtained in error and they should have recalled it from Jacobs with the local authority paying Jacob's fees, not you.

      Jacobs cannot remove goods from your parents' home that belongs to your parents. They are not the debtor(s) and Jacobs know very well they can only take goods belonging to a debtor.

      Jacobs cannot seek a Committal to Prison Order; they have no power in law to do so. Only a local authority has that power and, even then, the measure is intended for wilful non-payers, that is, those who have no intention of paying any Council tax whatsoever.

        Whilst you are negotiating with the council, or rather sending a Formal Complaint to CEO, elected Leader and your MP, make sure no motor vehicles are on or outside the premises,, and nothing else of value is in sight in a garden. As bluebottle states Jacobs cannot lawfully take anything belonging to your parents; however, Jacobs have a track record for clamping, towing, and selling third party cars as well as the debtor's motor. so if your parents have a car get it out of site also as Jacobs will take it and argue the toss later.

        Looks like the council are stonewalling over their error, and would rather you pay the Jacobs shark than them. Too much paperwork in their opinion to apply to quosh the Liability Order and recall the non debt as in fees only from Jacobs.

          I am wondering if the OP's former landlords should be held liable for Jacobs' fees, BB, as it was their error that lead to the chain of events which has brought the OP to LB.

            Might be worth a Letter Before Action to them, after sending an invoice for the bailiff charges.

              I totally agreed with you, BB. I am also of the view that the local authority's revenues staff, once the error became evident, should have recalled the Liability Order from Jacob's immediately and not let it continue as it has.

              At the moment, the matter is looking very much like maladministration, but if it the local authority allows it to continue any further, knowing what has happened, then it could develop into individuals within the local authority facing action for misfeasance.
