  • Halifax Bank/Nationwide Building Society Overdraft Fees

    Hi I have had thousands of pounds worth of overdraft charges with Halifax Bank also Nationwide the charges with Halifax are from 2003-2012 the ones with Nationwide are from 1999-2005. I have had some charges refunded from my Halifax bank refunded £100+ refunded but there was £1600+ worth of charges also I need to get back the charges on my Nationwide account can any help please.

    If the charges have pushed you into financial hardship you can contact the FOS and ask them to intervene, are the charges still ongoing and are the accounts still open.

      The Accounts are now closed but there was unpaid cheque fees of £25 overdraft fees interest fees etc I have contacted the FOS and got a nice call from Nationwide I'm not happy with them at all.

        Hi.

        I had issues with Nationwide too. Between 2007-2011 they took approximately £2000 from me in charges. It was absolutely crippling. I complained, detailed the hardship it caused, and ultimately took it to the FOS, who upheld Nationwide's defence, as they sent me phone numbers for two debt advice helplines. Apparently that is the extent of their responsibility. Ultimately I stopped using the account leaving it £200 overdrawn, and I took a prepay credit card from the Money Shop, using that to pay my bills, it saved my hide. I don't mean to dissuade you, there's a chap recently who had excellent results from a case (involved on this site), so perhaps that will give you some favourable leverage. Best of luck

          Thats the Oliver Foster Burnell case yep gonna keep fighting it and see what happens £2000 worth of charges would they have not refunded any of the charges as a goodwill gesture?.

            Almost the same thing but just with Halifax, found out , by accident they had taken over £3,000 in charges and defaults.
            During its life this account was a packaged account but at some time they changed it to a card cash account but still allowed an overdraft.
            Closed it four years ago due to the change in charges had to pay off a remainder.
            Recently I had to contact them on another matter to ask for statements and when they eventualy replied I found out about these charges.
            As the FOS were looking into the other matter I asked them to look at this.
            As this was just before the Orfoster case they turned it down on the grounds of the previous judgement and like you that the bank had offered " debt" advice
            ( they didnt).
            Asked them to look again after Orfoster but they have stil turned me down.
            Not giving up though but we may have to wait until after the appeal.
            Nothing to stop us doing an SDAR though!
            Thats what I am doing next week.

              You can get your packaged account charges back you could always contact the customer relations department and ask.

                  25135591: No there was no refund of charges. There was one occasion after I wrote to them the second time to continue the complaint, that they agreed to forgo one upcoming charge of £30. Apparently all the other charges they'd levied, and the resultant fact I couldn't control my cash flow or finances was my own fault, and nothing to do with them taking £40/month that I didn't have. £40 a month would have been cool, or even just easier had I been on a higher wage, but I was minimum wage throughout. So, the only goodwill they showed was to send two phone numbers, and let me off a single charge. To little too late! Nationwide are most definately not "On your side".

                    Ps, yea that is the Oliver Foster Burnell case, hopefully it'll set a more useful and useable precident than the UKSC 2009 judgement which threw a spanner in the works for so many people. I wouldn't mind so much, but the FOS have said it makes the charges allowable, and banks have used it as Carte Blanche to pretty much do as they like, whilst all it actually says is that the charges could not be assessed as unfair terms! Two of the lords involved even raise issue with the fairness of these charges. If this latest case doesn't change things then I would like to see lobbying of the lords for a review of this issue.

                      No The European 2012 Court of Justice Ruling outlined that it was unfair. Through sections 5-1 of the Unfair Terms in Consumer Contracts. There's loads of clauses etc that you can have them over by snowballing of charges financial difficulty. were going to have a good case on our hands . You should get all your charges back write a letter saying that your going to take them to the small claims courts.

                            Amethyst, what is the case then please? Obviously something's changed since the 2009 judgement. I wasn't aware of the 2012 European judegement, that's clearly been kept very quiet, and I pay a lot of attention to this issue. I have tried complaints, the FOS, lawyers, even Human Rights specialists. It's the hot potato that no one wants to touch, and suddenly there's a case where an individual has won against a bank in court, with the backing of a law firm obviously willing to take the case. Something has shifted.

                              Guitars it was a probono case. You can seek lawyers or legal representation that will help for free in certain cases. I'm annoyed myself that I've asked solicitors but they will charge you £180 an hour to help if you can get a probono lawyer or someone who can help then they can take the case to court and hopefully win. Its annoying that in my case I had to do most of the work on my own. I had help from this site which I am very grateful CAB were'nt very helpful Trading Standards said that I didnt have a leg to stand on until I researched information on Sections 5 and 7 of the consumer protections of the unfair tradings regulations the lawyers that I have called some were helpful some were'nt It just annoys me to think how can people afford £180 an hour we cant in financial hardship. I will keep fighting my case and help people like yourself and other people out.
