    Correct me if I'm wrong .... but surely if THEY cannot provide you with one, they cannot enforce the debt??
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

    It doesn't matter where your journey begins, so long as you begin it...

      They can "re-constitute one" from the terms in existence at that time....so long as it is a "true" representation.

        So you're hoping to see a real one to compare to a reconstituted???

          Debt's already been enforced, that's the problem. Once they have a CCJ they no longer have a duty to respond to a CCA request.

              Try to find out whether the form he'd have signed when applying for the card would have contained the terms or not, hence the reason for asking about the agreements from that time. It's hard to remember exactly what happened 15 years ago.

                It would be great if you guys could compile a database of copies of Credit Agreements. This would be a great way of stopping the bank re-constituting agreements in their favour. And assist in the whole unenforceability debacle........along with the "terms were on the back excuse." Surely some of the more fastidious people out there made copies before sending.:tinysmile_twink_t2:
