  • Marston - Warrant issues (No Bail)

Hi all, wonder if you can help.

    circs:

    - £1700 Compensation order in the Crown for fraud by false representation
    - awarded Sept 13

I was ordered to pay within 6 months, however lost my job due to conviction. Notified HMCS of this. Any extra money I had from my JSA I was using to pay of rent arrears.

I have now started working some 4 weeks ago, I have to go away on corporate business this Thursday to our France office until the following Monday.

Today I receive a letter from Marstons stating:

Certified Under the approval of enforcement ageny regs 2000

HMCS Cambridgeshire Magistrates Court ( No Bail )

"A warrant for your arrest has been issued by the above magistrates court in respect of unpaid fines or maintenance"

TO AVOID ARREST YOU MUST AS A MATTER OF URGENCY CONTACT THE WARRANT OFFICER IMMEDIATELY

The officer will provide information concerning the warrant of arrest.

For further information you should seek independant legal advice

If you fail to make contact or pay the sum due the officer will arrest you and take you into custody at the earliest opportunity.

    Signed
    Court Warrants Officer

    1. My first question is will I be arrested when I go abroad this week for work?
    2. I told them I had no money and I would contact them when I had funds, I have £532 remaining of my rent arrrears which will be paid at the end of this month then giving me some disposable income as of the following month, I dont earn as much as I did in my previous job but will be able to make monthly payments of £60
    3. I have had no other letter from the court since I spoke tot hem on the phone last year, this is the first letter I have received.

    Any advice would be welcome

You wont be arrested, but HMRC have more power than anyone so i would not ignore it, keep up the dialog even when abroad, get some dialog going via email.

        sorry my mistake,

is this direct from the Court or a private bailiff company. (read and look carefully) often this is sent to a private company who will use the name of the Court as a gimmick. they don't act for the court as they have took on the debt from the court!

It will pay to talk to them or you could voluntarily surrender yourself at a Police Station. You could be kept in custody until a Hearing can be arranged where you would have to explain yourself as to why payments have not recommenced. It sounds worse than it actually is - however if a Warrant has been issued it could possibly prevent you leaving the country.

Have you contacted the court to find out what they say about it?? That would be your first point of call in my opinion

I'm sure other Beagles will advise you too!

Call your local police station to ask if there is an outstanding warrant of arrest OR call the court that issued your original fine and speak to the court manager!

If there is no warrant, then Marstons have committed a crime :tinysmile_twink_t2:

You should deal direct with the courts on this one. If you can get time on mon or tuesday morning. Ring court on monday. Email them with your curcumstances stating when you will make payment. You will probebly have to sit in the court and wait to be put in front of a judge. Have your full finances ready. This is serious. Not like normal enforcment action so you have to deal with it asap. But the courts are a lot easyer to deal with than enforcment agents. For no bsil warrents for money. Its the courts not the police you deal with
crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even
