  • Fishing Trip on old CCJ

    Afternoon all,

    Have received a request to contact a certain firm in respect of a very old debt with a company who apparently managed to get a CCJ back in 2006. Obviously this no longer shows on any of my CRF.
    Am I right in thinking that at any time the DCA can apply for a charging order on my house and will get one, regardless of the fact that;

    a) I was not living at the address the court papers were sent too and therefore I was unaware of any judgment.
    b) this is the first contact ive had regarding this alleged debt.

    Bit anxious as ive just bought a house..

    Ahhh it'll probably be because you've brought a house that they've woken up.

    However, their sleeping period has been very excessive and they will really struggle to enforce after such a period of time.

      Ive already fired off an SB letter to them to see what their response is. Am I right in thinking they can waltz into court and obtain an CO? Bit worried as ive read many horror stories about interest being added, etc etc.

        They will have to apply to the court to be able to enforce the judgment. If this letter is the first you have known of the debt or the CCJ then you could try set it aside if they apply to the court to enforce.

        Have you not had any ill effects on your credit file over the past 6 years from having a CCJ registered ? (ie. was there definitely a CCJ registered and the DCA aren't just trying to scare you into paying an out of time debt)

          Definitely a CCJ, fell off my CRF in 2011. This is the first correspondence received. They obtained a CCJ by default as they sent the paperwork to an address id moved from.
