  • Letter threatening me with CCJ

    I've had a letter from a DCA chasing me for a an outstanding credit card debt with EGG.
    How they have traced me I have no idea this debt is from 2009. It's also in my old married name. The debt is for just under £3.5k.
    They've said of I don't contact them to discuss payment within 7 day of the date on the letter then they advise their client Cabot to start legal proceedings. Cabot had the debt from egg so I'm confused as I has it now? Cabot or marlin? Strange.
    Do I respond to the letter or ignore?
    They've done some searching to find me as I've loved several times since 2009.

    So you last paid or acknowledged this in writing in 2009?

    Also when did you first take out the Egg card?

      Yes there's been no payment or acknowledgement since October 2009.

      took the card out around 2007/8.

                  Do you have all the paperwork relating to this account?
                  When was the card taken out?
                  What was the default process?
                  Did you receive a Notice of Assignment that the account had been sold by Egg?

                  It would help if you provide a timeline of events in a dated list so we can see exactly what the history of this account is.

                      It's always best to respond rather than ignore, especially when you have a new DCA chasing you.

                      Which is more than I can say for myself, :grin: I've got an Egg card with a similar balance, last paid Jan 2010 by DD. It was always an online only account and the last address Egg had was for a place I sold in 2004. The Egg cards were sold to Citi, who had my new address as I've got a current account with them. Then sold to Barclays, where I've had accounts since 2008. Still, not a peep about this card! :tinysmile_kiss_t4:

                      It wouldn't be SBd yet since the limitation period is 6 years in England and Wales, 5 in Scotland.

                      After April 2007? That can make a difference.

                      Was it an online application? If so, the CCA request may not do much good, as you'd have agreed to the terms by ticking a box, as long as the application was made from 2005 onwards.

                        As far as I can remember it was over the phone I applied for the card.

                        It it will be 6 years at the end of this year.

                        i still haven't responded to this letter they last sent me as still not sure what to do and I haven't heard from them this week which I think may be a very bad thing!

                          That's good news, since they should have sent you an agreement to sign and return. :thumb: They can't fob you off with a computer printout of terms you "would" have agreed to online. :ranger:

                          Did you send the CCA request suggested above? If so, that would be the next step. :tinysmile_twink_t2:

                          Why should it be a bad thing not to hear from them? I've NEVER heard from anyone about my bad egg!

                            Yeah sorry I did mean next year it'll be 6 test not this year. Doh!

                            I havent sent that letter yet as was going to wait and see if they send me anything else.
