  • M&S store to mastercard - letter from Credit Security Limited

    Received the following letter from Credit Security Limited after clearly notifying them that I would not be discussing the alleged account with them:

    "Dear Mr $quandaŁot

    We write further to your recent communication with this office.

    You will be fully aware from our client's letter dated 12th July 2013 that the agreement provided is fully compliant with the Consumer Credit Act and we therefor confirm that the above balance remains outstanding.

    We will be pleased to agree an affordable repayment plan if you will kindly complete the enclosed Current Information Form and return to this office. Alternatively, please telephone one of our trained advisors on 0844 2439931 who will be pleased to assist you in resolving this matter.

    Not sure if I should just ignore it (have told them that I wouldn't necessarily respond to further letters), sent them a one liner referring to my previous correspondence or send them one of my Mayhew specials?

    Well, it's only taken them 9 months to figure it out! A lot can happen in nine months!

    Assuming this refers to the same credit card this other thread deals with: http://www.legalbeagles.info/forums/...card-what-next then the agreement may well have been fully compliant when the STORECARD was taken out in the late 90s, but that agreement wouldn't have been for a credit card as we all know. :nono:

    I would just refer them to previous correspondence. Presumably you have already told this lot about the case in question, which, despite not setting legal precedent as such, would be hard to beat, as I understand it. :juge:

    You may want to re-read what PT2537 had to say last year with regards to correspondence:

    If memory serves me, I don't think the debt in the Mayhew case was disputed before going to court, it was being paid and they still went to court. Making clear why this debt is being disputed may well keep it from going to court. :thumb:
