  • Jefferson Capital SRJ Debt Recoveries Bryan Carter

    Hi All
Not been on here for a while as all has been fine
I got a letter out of the blue in March from SRJ collecting on a debt for just under 4k on behalf of Jefferson International I had never heard of them but I think its for a Monument Debt which I have not paid for just over 2 years.I was paying them via a self managed DMP they wrote to say they were no longer collecting I had loads od DCA badgering me including CAPQUEST I wrote to Monument asking what was going on and who was collecting they sent a letter back stating they had not asked any of the DCA to collect and could I forward any letters especially from CAPQUEST which I did and did not here anything else .
Now I have these letters all of which I have ignored until Bryan Carter Solicitors this morning stating I must contact SRJ or the account may be passed to them to take action to recover the debt.
I have read loads of threads on here about MR Carter and did not want him sending out a court claim as he is reputed to do regardless could anyone advise on my best option I do not know if Monument have passed it on as they have not written to me and considering the fact they did not who was collecting I am assuming its never been sold on either
    Thanks

Can you scan or take a pic of the letter, remove all personal details and post up here? :typing:

Let's see what BC have to say, it's not like them to send lots of letters, they tend to head straight for MCOL.

I'm fine, thanks, hope all is well with you.

That's a rather mild letter from BC. :confused2:

Have you sent Jefferson International a CCA request for this account? May be worth doing so.

Just reading up about Jefferson International they took over CARS DCA last year Cars were the last ones chasing this debt
I have dug out a letter I sent to Monument asking them to Clarify if Cars should be collecting and I also sent a Prove It to CARS
I got no reply from Monument but got a reply from Cars stating what I owed and stating I would have been informed in my terms & conditions that my account could be sent to a collection agency should I miss payments
Is this right sounds fishy to me thats why its so confusing and they obviously cant issue court proceedings as they are only collecting so that must be Bryan Carter over stepping the mark yet again

That's fine, you are entitled to send a CCA request as long as you haven't sent one in the past 30 days for the same account. That should help you if BC try to get heavy. :thumb:

              It is very confusing indeed!

Any idea WHO of the above actually OWNS this debt? From your previous post, I got the impression it was Jefferson International/CARS (now all part of the same company).

In any case, you can send the CCA request to whoever is chasing you, they'll have a duty to pass it on to the account owner who in turn, will have to get the documents from the original lender. Sending a copy of said request to BC wouldn't be a bad idea either. :ranger:

                Hi FP
Thanks for all your help today
CARS did state they were collecting on behalf of Monument so I think Monument must still own it
I will CCA SRJ and copy Bryan Carter as you suggest

we can see where this is heading then think that`s why I ignored it !!!!!!

                    Indeed I can! :thumb: :bounce:

Having said that, we know BC are trigger happy and their little fingers are probably glued to the MCOL website, so it's best to cover yourself with the CCA request. As you will see from dozens of threads on here, they always issue claims without EVER having the documents, in the hope of obtaining default judgment or an admission.
