    Hi all doing a seperate thread (so the ganes begin)
    I have a debt with Arrow paid on a DMP with Wescott until they wrote and said they were not collecting anymore
    Debt passed to SHoosmiths for collection sent off CCA request got back copy of original application form (looks like a leaflet) and pages a nd pages of TCs
    My question is do I negotiate a new repayment plan as I was paying them back so if it went to court if I dont pay would I not stand a chance because of this I have no idea what to do

        The T&C s attached supposedly to the application are not legible even through a magnifying glass so wont scan

          I have been reading through some other threads should I just write and say its barely legible and I cant make a judgement as to if its original or not
          from what I guess an application and T&Cs only fills the s78 request but does not mean they can take me to court just wanted to know if I have been paying though is that acceptance of the debt and would I stand any chance if it went to court

            If it's not easily legible then it does not fulfil s78.

              So shall I write to shoosmiths are they in default of my s78 request as its ilegible would that be the correct wording
