Hello, I hope I am on the correct thread here. Can anyone tell me if a joint executor who is also a beneficiary has the right to charge for work they have done?

My understanding is yes they can charge for out of pocket expenses. Can I ask what they are charging for and whether that is outside of that remit?

....but only reasonable expenses. they cannot charge for a casino trip to Monte Carlo but they can for telephone calls made to execute the will as can you do.

I believe that reasonable expenditure such as essential travel , phone calls etc can be claimed for. My sister who was an executor of my dads estate had to travel on several occasions from Maidstone to Crewe. This was claimable, what wouldn't have been would have been hotel accom.

As previously advised, Yes, you may charge for reasonable expenses. You could charge a fee, but I wouldn't recommend trying it. Take care to keep precise accounts lest you be challenged later. No matter how trivial, receipts are a must.

Hello, yes of course you may ask. I am one of two beneficiaries. My sister and my cousin are both executors. My cousin is asking for a goodwill gesture of 1,000 from each of us (but hasn't asked my sister yet). I am just worried that if I agree to anything, my sister will then come along and ask for the same. Also my cousin informs me he by law, can charge 2 to 4 per cent for being executor, although in the first instance he did say he offered to do the job and therefore would not charge. The estate is almost tied up now and suddeny my cousin asks for 500 from me as a gesture of goodwill and then it went up to 1000. As he holds the cheque book, I need to know where I stand as they have not opened an Executors Account only a joint account. Sorry this is such a long drawn out story but it is exactly how the situation has evolved. I was told from the beginning, you are only a beneficiary, nothing is your business. I have asked for bank statements as I know my mum loaned my sister 10,000 pounds 18 months ago, but I am not getting anything back from the Executors. Please advise.

Would someone be able to merge this thread with the other thread which is the same one. Unfortunately I put it on the wrong part of the site in the beginning and someone transferrred it for me, but I also put in on the correct thread as well. Does anyone know how to merge them? The answer to this question might depend on the nature of the bequest to the co-executor.

One could certainly imagine an accountant or lawyer seeking to charge more than mere out of pocket expenses unavoidably incurred, especially if their only bequest in the will was to be given a lemon (or a pebble) with the instruction, "Now squeeze this!"

An amount of money was passed to an executor in cash, so not proveable?

How?

Was this the contents of the deceased's wallet, or cash found in the deceased's knickers drawer?

If the other co-executor believes that money or other value is being improperly removed from the estate, a challenge could be made to remove the executor who may have been embezzling from the estate.

i think you need proffessional advice from a probate lawyer if not once they take the money it will be a fight to get it back
