  • PPI RECLAIM YES CAR Credit

    Hi All,

    Having had some success with other PPI reclaims (Capital One CC) I am now embarking on tracking down YES CAR CREDIT.

    Like most people that went to YCC we were in a finnacial mess, low income a failed business behind us and "YCC could help us rebuild our credit rating" !!!

    We purchased our first car from them in 2002. and the second in 2005. How far back can we go with PPI Reclaims ?

    Both were sold to us with PPI, GAP and warrenty as a pre reqesite of the sale to "be accepted".

    I have prepared a (SAR) Subject Access Request Letter as I no longer have any paperwork relating to either transaction.

    This i intend to send to:

    Bradford
    BD1 9PU

    I will post back the results and the steps I take until the matter is resolved.

    please keep your thread updated ebery step, does not matter how small you think the information is worthy.

                    Dear Sirs,

                    I bought the above Vehicle from you on 19/08/2002. This included PPI, I now wish to claim back my premiums plus interest. This policy was mis-sold, I contend, for the following reason/s.

                    • I was self-employed and could not have claimed fully on the policy without ceasing work – a more onerous condition than someone employed. I was not informed or warned of this.
                    .
                    • I told your staff about my medical history but I was not warned this would
                    invalidate part of the policy.

                    • Your staff stated or led me to believe that taking out a policy was a pre-condition of applying for a loan and would improve my credit rating.

                    • Your staff did not offer me a clear choice of the loan with and the loan without insurance.

                    I now contend that I was mis-sold this policy. I claim back all the premiums and interest I have paid in connection with this payment protection insurance policy plus statutory interest at 8% from the first payment that I made until the date of your settlement of this claim.
                    I would like a reply as soon as possible but, in any case, within the eight weeks allowed for responses to complaints by the Financial Services Authority.

                      Hi there,i have also sent a letter to yes/DAF at the adress in bradford,but have waited over 8 weeks and heard nothing,FOS said because it was late 2002 need to go after the insurance underwriter as this was prior to 2005 so i may not get anything back form DAF.

                        Time for an update.

                        Well i have dragged my heel a little on this one.
                        With Christmas finally out of the way i sent off my letter for the first car we had from yes car credit (we had two the second we declined the PPI)
                        they have responded in good time asking us to fill out the PPI Consumer questionnaire from the ombudsman's web site and return it within 28 Days.

                            Write to the Manager/CEO (Chief Executive Officer) ask them to review by 14 days, and state to them that in your letter you note they have basically said you waited this long to raise the complaint, confirm that you have only recently become aware of the mis selling of these insurances, where you realised that you have a case with the reasons you sent the complaints dept.

                            I would also confirm that you assumed it all part of the package as you were pressurised into taking out the policy as if it was part of the complaint package and note you DO and DID have pre-med conditions at the time it was added to your finance, but as the policy was not thoroughly discussed by your adviser who applied these insurances.
                            I also believe it is now poor selling tactics to have been informed that having the insurance - to improve my credit rating!

                            I would also add, "if I did state that I recommended a friend" this does not mean it counted for the sale of the insurance, but the sale of what you purchased, and please provide me "concrete evidence" of what you hold on the sale of when the insurance was sold to you, as I believe that you must have this information on your systems to have come to this decision.

                            "The policy was worthless to me, and I now realise it was not sold to me in my best interest, as it was no gain for me but for the sales adviser who pressurised the products on to me for their own gain".

                            Ask to review by 14 days, and state that you have not had the opportunity with the complaints team to forward further information, so as a respectable business you believe will reconsider my complaint and take into account my further info I have provided to you.

                            Also request for details of the Underwriter/Insurer, as its possible the FOS will not be able to adjudicate this complaint if they were not then FSA regulated at the time you were sold the policy.
                            (That is standard what they add about the FOS), and its highly likely the underwriter/insurer will have been regulated, (as for dealing with the insurance before it was accepted for you).

                            We can then move on to the underwriter if the CEO does not get back by 14 days or overturn the decision in your favour.
