    I started working for company on 29th april 2010 and work 20hrs per week.

    I am due to go into hospital for operation on 14th march and will be out of action for upto 6wks.
    I have been told I can use any holiday entitlement I still have left to cover the first 2 weeks of my absence then after that I wont be paid till I return to work.

    I want to know if I am entitled to sick pay after only bein with company under a year.
    also, why do I have to use my holiday entitlement to cover this period?...thats unfair.
    Apparently I have to take my holidays before end of march anyways or I lose them and dont get paid for them.

    Can someone help here and explain what my rights are please

    Who can get Statutory Sick Pay

    You may be able to get Statutory Sick Pay (SSP), if you have:
    • been sick for at least four or more days in a row (including weekends, bank holidays and days that you do not normally work)
    • average weekly earnings equal to or more than the Lower Earnings Limit (LEL)

    Lower Earnings Limit (LEL)

    The LEL is the amount you would need to earn before you start paying National Insurance Contributions. From 6 April 2010, the LEL is £97 a week.
