  • Receiving threatening letters from DCA.

    Hi everyone.

    Last year completely out of nowhere I received this letter from a DCA.

    As you can see it does not actually tell me a lot so I just sat tight and waited.

    Letter two arrived soon afterwords stating that I owed £41 to BSKYB. Complete news to me. Ive had no letters from BSKYB asking for money.

    My response was a letter denying all knowledge and asking for them to clarify the matter by providing me with details of the account and credit agreement.

    Letter three arrived soon afterwards



    Has anyone else dealt we these people as they are beginning to intimidate me now, and Im finding the whole thing embarrassing to my fiancee. I have a squeaky clean credit history with Experian and wish to keep it that way.

    Ive sent another letter outlining my rights according to the CCA rules and enclosed the £1 postal order asking again for all the relevant details.

    Can anyone please tell me the best course of action

    New ones on me.
    Now this debt is NOT covered by CCA, but a simple "Prove It" goes a long way.

      I have already dispatched a Prove it Letter and now more recently a Full CCA request.

      The response I had after sending the Prove it letter was The Notice of Impending Court action.

      Whats so funny about this is that I have no default letters from BSkyB. I have within the last 6months taken on Sky+ in the household but this account is furnished via DD with absolutely no default.

      If this debt is not covered by CCA does that mean that all the letter templates available do not count in this instance.

        Follow the NON-CCA route.

        Bear in mind all of these "responses" are simply templated and as such can be ignored.
        YOU have made every reasonable approach to them which they have chosen to ignore.

        Shame you didn't ask earlier as a full CCA is meaningless in this case.

              As you have already thrown a Prove It at them there isn't really anything else to be done.
              Until such time as they are courteous enough to address your issue you have nothing to say to them at all.

                Blimey is that it then. Wait until they start responding to my demands of Prove it Letter.

                Do I simply ignore the threats that they are sending out i.e the third letter received from them.

                  Yep that's the one.
                  These letters are churned out by their threat-O-Matic until people pay up.

                  You have already made reasonable efforts to engage them in meaningful dialogue, so it is up to them to show your liability to this alleged debt.

                    Many thanks for all the advice. This process is all so new to me and as such feel very intimidated and angered by it.
                    I've noticed that some people go down the route of Tacit agreements. Is their anything to be gained from that.

                      Just had another letter back from DCA (this time quiet faded/no colour)

                      It states that they have been in contact with BSkyB. The account relates to a property that I left 5 yrs. 11 months. ago (my ex wife took over the house).

                      Due to DATA protection act the DCA was not given any information from BSkyB (that I requested in the prove it letter), they have asked me to contact BSkyB directly.

                      (In the meantime they have offered to put the account on hold for 21 days to enable me to contact BSkyB and gather the information that I seek).

                      So it seems that the DCA will not comply with the prove it letter or provide the specific details that I asked for from them.
                      Is this because they do not hold this DATA?

                      Im so angered by these threatening letters, why should I do the running around.
                      They started this surely they should now provide all the information I requested from them?

                        Remember it is the DCA's job to prove your liability for this debt, not yours to show otherwise.
                        That being said until they furnish this information they are, basically, burgered..

                        In this case they are clearly acting as an agent and as such have zero legal powers to pursue you further for this alleged debt.
                        So all in all game over really..

                          Well that is re assuring to hear that you agree with what Im thinking.
                          I have however read somewhere that a DCA, as a leaving present,left a default notice on the individuals credit file.
                          That individual now has to go back to the DCA to have this removed as the CRA (experian) will not remove it even though the account is in dispute.

                              Does it involve lots of paper work. My case is not strictly CCA related.
