  • Industrial disability and pension

    I was forced into ill-health retirement by management and was given (the standard?) 6 years or so enhanced years on my pension. Some time later, DWP decreed that I had been industrially disabled. I've researched the tax implications of this, but it's turning my head to soup. Can anybody help please?

      to be forced into retirement due to ill health/mental health, the company needs a report from a medically compitant person, I.E a doctor, phycologist etc,
      without this proof, your company would be putting their head on a pretty wide chopping block.
      Usally industrialy disabled would point to an accident at work.
      Have you been abscent from work due to stress or an industrial accident?

        Hello strangewayofsavin, The occupational health report concurred with my own GP's assessment that permanently unfit for work. It was a work-related psychiatric injury. The DWP subsequently decreed that management's handling of my concerns at work is what led me to being seriously unwell. I don't know if DWP decision supports me in any way against claiming against employer liability insurance, but I've certainly not found any solicitor who is prepared to take on the Home Office. The specific query about industrial disability and pension is a tax query as pension years added due to industrial injury should be tax-exempt. I believe that NHS and Fire Services get added industrial injury pension years, but cannot find any record if Probation Service does. I don't hold out much hope though as they are a terrible employer.

          As the Government was your employer, and the DWP, was also a government agency, just shows how out of touch they really are, perhaps you should read the employment rights act and the mental health act, both available on www.statutelaw.gov.uk
          All companies have a duty of care, where mental health issues are concerned.
          I would suggest you find an employment law specialist (with help from medical reports) to handle your case, as they could easily point out the ludicrous contradictory rules that govern government controlled entities and the're frame work structures that impose impossible targets, therefore impeading your core human rights.

            Thanks for that suggestion. As it happens, last week I stumbled across a feisty employment solicitor who works for a local law centre. I'm going to book an appointment to see her. I'll let you know how I get on. Cheers.
