Delivering court order to defendant in a foreign country..!!

  • Delivering court order to defendant in a foreign country..!!

    Hi all,
    I am posting this in order to help a relative of mine.

    She got a CCJ against a debtor . But debtor ddnt pay anything. Then she applied Attachment of Earning ORDER but employer informed court as the debtor already quit employment with him. She dosent know where debtor works now .

    So she applied for an order to obtain information and court has sent the order to be delivered to the debtor in person to come to court. The hearing is set to be heard on 1 February 2018.

    When she tried to deliver , she came to know that the Debtor has left UK and doesn't know when he will come back to UK. But She got to know the place and address of the debtor in the country debtor stays. If so ;

    Is there any way to deliver this court order to the debtor when he is in a foreign country ?


    If can, then how can file certificate of service to the court ?

    if can not , then what should she do ?

    please help.

        CPR 71.3 2)If the order is to be served by the judgment creditor, he must inform the court not less than 7 days before the date of the hearing if he has been unable to serve it.

          Loads of questions to ask.

          Who did they live with when in the UK?
          Did they or could they have left behind property?
          etc etc

          Personally I would have paid £66 & instructed high court bailiffs to recover. But what are the circumstances?
