  • Court Claim - Lowell / Shop Direct Ltd - 9-1-2018

    Received a claim? Yes
    Issue Date: 9-1-2018
    Amount approx: 418
    Claimant: Lowell
    Solicitor: B W Legal
    Original Credit: Shop Direct Ltd

    Particulars of Claim:
    Default Notice
    Assignment

    Stat Barred? No

Have sent: Acknowledged the Claim, Sent a CCA request, Sent a CPR 31.14 request

    Other Info:
Am being chased for a debt I do not recognise as the amount had been paid in full to Shop Direct. I spoke to Lowells repeatedly (unfortunately by phone so I have no records) about providing me further information about the debt owed. Each time they phoned I requested further documentation which they said they would send but never did. Last contact with them was in 2015.

    Hi, Welcome to LB,,

You have all in place correctly.

    Two suggestions:
1, Give shop direct a call about you having paid the alleged debt, some times they can be very helpful.

    2. You could send SD a subject access request made under the provisions of the Data Protection Act 1998 to get all the personal data the company holds. There is £10 statutory fee for this, there is information on this in the green box above.

SD has 40 calendar days to comply so the phone call maybe first.

Some more history of the alleged debt may be helpful.

Thank you so much for your reply! SD were actually the first people I contacted as there was no detail on my online account on any amount owed and no emails from them but I was told because the debt had been passed on to Lowells already then they could not assist me.

Should I still go ahead with the subject access request?

        Hi,

Yes get the SAR done asap and use signed for post.

My guess is the particular operative at SD could not be bothered to help, they must maintain the data for 6 years after the account was closed sold on or not.
