  • Judgement for claimant by default - want to pay before 30 days but how?

    Hi everyone,

I've just joined, as can't find exact answer to me question:

"Should I sign up with Lowell Solicitors site to pay CCJ before 30 days" or will this then give them more information to look me up for more debts that are near 6 years old unpaid?

If the court form from County Court Business Centre had how to pay on it, like bank account details, I'd pay in full.

I'm nervous of signing up to Lowell sharks site as they've been sending a few letters (perhaps 3 debts), all of which are ancient.

I screwed up and ignored the original court letter on this one, and got a CCJ but if I pay quick, with proof, it'll go away as I understand it.

I want to do that but I don't want to give Lowell MORE information about me by signing up to their site.

The total is £300 ish and whilst I will struggle, I want to pay it with proof I've paid ASAP (I'll need a week to raise funds and I have until the 5th Feb 18, it is now 13th Jan 18).

I should have fought it looking back, as I took out a payday loan I think, and wasn't working / couldn't afford it even (was out of work on sick). I read somewhere that in itself is a defence. But now I have the CCJ looming, there's no pont paying £255 for the fight form thingy, when I can clear it for a little more money.

    SO in a nutshell:

How can I pay Lowell Solicitors, and then provide proof of payment to court, all in time, without getting a CCJ for 6 years and without signing up to Lowell Solicitors site (Googles answer to how to pay, but I fear this will spotlight me with them).

Also is the claim real? My stamp just says The county Court. All others I've seen on the net say Northampton etc in the stamp. But I have a claim no. ref no. and it says County Court Business Centre, so seems real enough and scary enough to me.

I work for an FCA registered company, so a CCJ really isn't good.

I've had depression for 2 years, still worked 75% of the time, and am now getting well, but being whilst down I racked up debts (again) retail shopping online I guess you'd call it, but before that was last in debt in 2012. I guess that because 6 years is approaching, I may get lots more of these, and I live hand to mouth, my only asset is a £1500 bike, which I can't loose / have taken away, it is my anti-depressant and if you're a biker you'll know what I mean.

I'm in a financial mess, but with time and care, I'll be OK in 3 years, unless my debts from 2012 (last payments around July) arise.

Currently all debts I have I'm paying with no defaults or plans.

    Thanks everyone :-)

Re: Judgement for claimant by default - want to pay before 30 days but how?

Hi thanks for such a fast reply,

I was hoping to online bank it or pay by card. A card would be ideal because then I'm not using my bank and whilst borrowing from Peter to pay Paul, it'll be quicker / less waiting period.

Then I sign up to The Business centre site and send proof electronically? I read somewhere they don't deal with forms or paperwork? I could be getting myself panicked over too much reading and misunderstanding!

I could go to the bank and get a cheque printed off, I guess, the letter says claimant is Lowells but payment to Lowell Solicitors (different address), so I'd better pay there I think?

To pay via cheque I'll need to visit the bank and they'll print one off (not sure of charge), then my proof would be photo of the banks printed cheque and proof of posting? Or electronic by signing up with the Court Business Centre site?

      Thank you again, very appreciated.

Oh I remember now, I couldn't sign up with the government thing because no "MD" number or similar. I only have Claim number. Maybe MD no. is the reference no.

        I'll try again now.

No, it's the defence claim password I need that I don't have. Not sure where I got the notion of MD from.

          This is me panicking.

I'll take 10 and level myself!!

I just wanted to make sure the thing was real, as mine looks like a photocopy. So wanted to login there and hopefully confirm it.

Guess I'll have to phone them Monday...........

Do you have a friend with cheque book who will write a cheque for you?

You could also look at making an affordability complaint on the original payday loan- entirely separate from the ccj - the complaint would be made to the original lender - but get this CCJ payment sorted first so it doesn’t affect your credit file.

Re: Judgement for claimant by default - want to pay before 30 days but how?

                Thanks for all your help.
I emailed them and they sent account details and said pay Lowell Portfolio, not solicitors, but the court order says pay Lowell solicitors.
Anyway, I now have written email evidence and also a letter arrived today saying if I pay within 30 days (I have until 8th Feb), they will notify the court for me, although I plan to notify them too myself with all copies of proof of payment.
BUT I also found out the debtor was BT (haven't used BT for many years, and another Lowell debt letter, different reference, came for another BT debt today from Lowell!!
Do I ignore this and wait to see if they are bluffing (after all I've been throwing their letters away for years and except for ignoring the court one, never had a problem. Or should I send one of the templates on here about it being over 6 years old.
They've also sent another letter about a debt to an old payday loan (which I thought this was all about), saying they've sold that debt.
I knew once I made contact they'd bombard me from my troubles 6 years ago.
If I can just ignore a few more months I'm definitely over the 6 month statute since last payment to any of these people.
So in short, should I ask Lowell to prove the debt is within 6 years now, or wait for another court summons then do it? What is the general consensus?
Obviously the court one I'm just paying in full, because I don't want a CCJ.
                Thank you so much.

(Although I'm not paying in full for a while because I don't get paid for another ten days or so.......)
