  • Long term temporary promotion

    Hi,
    is there any stated case law to say a certain time completed as a temporary promotion constitutes a permanent promotion.

    If the company has previous permanently promoted people after 4 years in a temporary position/rank , are they obliged to do the same to any staff who reach that time?

    For clarity no time limited temp contracts are in place and the pay and condition including pension contributions have been at the temporary promoted role.

    Looking for advice or direction please.

    There is no case law that says an employee of the company who has been temporarily promoted to a position has to be made permanent in that position after a certain period of time.

    The company is not obliged to unless it has happened every other time and on a regular basis in the past and then there may be a possibility of arguing custom and practice.
