  • DVLA court Hearing

    Hello,

    I was hoping someone could shed some light on this for me..
    In October i got a letter saying I had historic debt of £250 relating to a dvla offence (not posting v5 back after vehicle sale) and that I had not responded to court summons letters so a hearing was held in my absence in 2010. Ive moved about ten times since this court hearing happened (2010) and this letter has been the first I heard of this.

    I have made a statutory declaration at my local magistrates which was accepted , however they said because the original hearing from 2010 was held in another court (other end of the country) that a new hearing date has been adjourned to that court for December.

    I don't understand why if my statutory declaration was accepted? Does anyone have any idea ? My local magistrates have been very vague on the whole matter.

    I have spoken to the other magistrates where this new hearing will take place and they said if I plead guilty I can do it via email but if I plead not guilty then I need to go to court. I admit its my own silly fault for not positing a v5 form back but I am not guilty of ignoring court summons. Will I be digging myself a hole if I plead guilty by email ? I'm feeling very confused

    Have you considered calling the DVLA and settling up now than having to go to court? Court is a last resort so if your prepared to pay now and not get a conviction, you should do that in the first instance. If the DVLA refuse then you could argue that they are being unreasonable and difficult for no apparent reason. Payment should be made on agreement that the case is withdrawn.
