  • N24 General Form of Judgement or Order

    I had a car on finance and due to loosing my job I was going to start struggling so a friend of mine offered to buy the car off me by taking over the monthly payment so I drafted out a document to say he would pay the £347 a month and the £23 a month for road tax for the car, the log book was to stay in my name until the car was paid in full.
    2 months down the line my circumstances changed again which meant I could afford the payments again, I spoke to him and offered to take the car back but he refused to give it back Since I needed the car for work and couldn't get another car finance with that finance still outstanding in my name, I decided to go pick up the car from his house since I still had the spare key.
    I received a claims form from county courts business centre through the money claims online service that he's requesting the 2 months payments he'd made to me.
    I completed a form online to say I disagreed with the claim and also made a counterclaim to say the payments he made went to the finance company for the car and road tax towards the car, and since he had used the car during that time to the tune of over 2000 miles in 2 months, I didn't owe him the money. I also went on to explain that my counterclaim of £250 was for the deactivation and replacement spare key and car's manual and service book he'd refused to give back to me.
    I then received another letter giving me the option for the case to go to mediation which I accepted. About a month after that . Not hearing anything back from mediation, I have today received a ''N24 General Form of Judgement or Order
    saying ....
    UPON no attendance by either parties
    IT IS ORDERED THAT
    Judgement for the claimant against the Defendant in the sum of £856 to be paid by 4pm on the 22nd Nov 2017.
    I need help with
    1. What are my options here as I believe this isn't fair as there has been no negotiation of discussion about this at all
    2. Will this be recorded as a CCJ on my credit report?
    3. Is there anything I can do to appeal this judgement to maybe get it to be set aside?
    4. if I do have to pay it, is there a way of arranging a payment plan through the courts as I don't have that kind of money sat there?
    Any help will be appreciated .
