    Hi everyone,

    I signed up to the site today and would like to say hi to all.

    Secondly, I would kindly like some advise on a 'Parking Charge Notice' I received from ParkingEye Ltd at a Morissons Supermarket.

    When I arrived at the store, I received an emergency call and was in my car on the call for 20mins before buying a Parking ticket at the ticket machine.

    I went to the café and paid by cash, later bought some items in store which I paid by cash and used my card to pay for some items worth £7 and had the car park ticket refunded because it was before the expiry time shown on the ticket.

    Two weeks later, I received the parking charge notice of £100, discounted to £60 if paid within two weeks. I appealed to ParkingEye Ltd that I had an emergency call for 20 mins before buying a ticket and was within the time frame of the car park ticket. They advised that I should show evidence as proof of purchase. I had already disposed of all my receipts and had to go to the Morrisons that's 45mins drive from me. I got a duplicate receipt and sent it to ParkingEye who rejected my appeal that it does not meet the Landowners discretion criteria, and I should appeal to Popla. They also advised I will have to pay the full amount of £100 if I go through Popla's appeal process.

    Can anyone please advise. Thanks in advance.

    It would appear that in your communications you revealed who was driving at the time of the contravention.
    Could you confirm this to be so?

        You say 'emergency call'....are you part of the emergency services? MD or similar?

          no i'm not part of the emergency service., my daughter fell down and hurt herself, I wasn't there but had to make sure she was ok.

            I'm guessing that your vehicle was captured by ANPR.

            Could you post up a pic of the postal Notice to Keeper anyway? (Front & rear, obscure personal details but leave dates & times visible.)
            As you have ID'd the driver it might not be applicable, but it's worth a shot.
            Also a picture of the site sign.

            PE are usually pretty compliant, but they've been a bit haphazard recently.

            Even if POPLA don't allow your appeal, you do not have to accept the decision, whereas if you are successful, PE do have to abide by it.
            But the downside is that PE do issue county court claims; in fact they are probably the most litigious parking company around.

              I will post the PCN by tomorrow, and try to get somebody to take a picture of the car park sign, as I am about 45mins drive from the store.

                  If you can contact Morrisons and complain and ask that they get it cancelled.

                  Secondly, the parking contract appears to have a hidden term that you were not made aware of. Rescind the contract now.

                    Hi,

                    I initially contacted Morrison before appealing to ParkingEye and they were not co-operative. They advised I have to contact ParkingEye as they deal with the parking. It has nothing to do with them.

                    Can you please advise how I can rescind the contract and if possible a draft letter I can send to Popla. ParkingEye has stated that I can no longer appeal to them because they have refused my initial appeal. I should either pay the fine or appeal to Popla.

                    Please advise I have no idea how to go about it. Thanks

                      I have gone through ParkingEye's Appeal Form again and type in the reason for appeal box, 'I hereby Rescind this parking contract as it appears to have a hidden term that I was not made aware of'.

                      Can you please advise what I have to do next and if possible send me a draft letter I can send to Popla. Thanks in advance.
