    Hi
    I won a claim by default and a judgement was issued against a car dealer for selling me a car which became unroadworthy within a month of purchasing it. They ignored the judgement so a warrant was issued. 12 days after the warrant I received notification a bar was put in place for the defendant and transferred to their local court. Any advice what this means would be appreciated. I made my claim via MCOL.

    This will mean that the defendant has submitted a set aside application to the court to put the warrant on hold and overturn the default judgment. He should have served a copy of the application on you - whether the court do will depend whether it is an application for a reason other than error of the court ( eg he filed acknowlegdment but it didn't get applied to the record etc ) - or could be you issued the claim to an incorrect address/party. It's transferred usually for a hearing of the application so you should get something from court. Best thing is to ring the court monday and say you haven't received a copy of any application.

      Thanks for your advice. I phoned the court and was told the Judge is still deciding what to do with the case. I don't understand how the judge is now involved when the defendant received a judgement and a warrant was issued because they chose to ignore it. All the correspondence went to the correct address. I thought they would ignore it as they didn't respond to any of the previous correspondence I sent which they received as I had it sent recorded delivery. Will I have to attend court?

        I don't know as yet, it really will mean waiting for the Judge to send out his directions. It's likely the other side have applied to the court but the call centre should have been able to tell you that.
