In June I had work completed on my flat by a qualified electrician - the work was sub- standard - and I complained verbally and I followed the CAB advice and sent e mails out lining my complaint. I had paid for the work as I did not know how I stood legally if I with held payment. To cut a long story short - from the start of my compalint I sent 5 e mails out lining the complaint and seeking to find a reasonable resolution. The electrician reported me to the police for harassment - I was sent an e mail by a WPC. The police did not ask for my version of events. I made an offical compalint as I had not been treat either fairly or impartial and my copalint was about how the police handled the situation. I gained access to the police report. I also informed my MP for help with this matter. I have now recieved a call and a letter from a Police Inspector - who made a plan of action which involved talking to the WPC involved in the matter. She says she stands by what she did and that an assumption on the police part was that the electrician had provided evidence that was true. The police report I gained access to is a total fabrication on the part of the electrical. I have received a final letter from the police inspector saying basically nothing is going to happen - i have not been issued with a PIN. But the electrician lied to the police - what come back do I have. I am tking him to small claims court to try and get a refund for the work he completed which was appalling. In the report he said I was 5ft 8 and 53 (I am 5ft 4 and 65) - he also said I had said I would ruin him and send my friend round. totally untrue. Any help would be good. Thanks.

What a nightmare are PINs, but there is little a recipient can do.
A false allegation is made, and the police take it at face value and issue a Police Information Notice, which cannot be challenged, except by judicial review or rescinded by police agreement.
Judicial review is costly.
Did the police agree to rescind it?
Viewing your age (no disrespect intended as you are luckily younger than I) you probably won't encounter the problem with an undeserved PIN of showing in an enhanced DBS check
Presumably the advantage is to the police bean counters who see a conclusion at little cost.

Hi - I still work and still require an Enhanced DBS check every 3 years for my job. No PIN was issued - and e mail warning was sent to me. But what about the factual inaccurate accusation made by the electrician - should he be challenged by the police? His claims are outrageous. My compalint to the police - Disney Princess alleges that the decision to crime harassment from essentially a civil matter was wrong. The complainant does not consider that both sides have been considered and that the possible effect on her career with regards an enhanced CRB check has meant that the complainant is not satisfied with the manner in which this matter has been dealt with.

The police Inspector said ‘For clarity with regard to the outcome of this crime report, the injured party (the electrician) has made an allegation of harassment. In line with National Crime Recording Standards, this matter has been recorded based on the fact that the allegation was made, an assumption in believing the complainant and that there was no immediately available evidence to the contrary. He has not supported a Police investigation and as such, based on this, no further investigation has been completed and as such no action taken against Disneyprincess.

I always though in the UK you are innocent until proven guilty - and I don't think that included assumptions! What can I do?

As far as I can see, the police have taken the path of least resistance and closed the matter. As far as any record is concerned, you do not have one so are indeed innocent.

If a complaint is made, the police are duty bound to investigate to some point and they seem to have done this and decided no further investigation was warranted.

With regard to issuing a claim in the small claims court
First question, was the electrician registered with any trade associations for example NICEIC - for example did he issue a certificate saying the work complied with regulations.

If you want to go to court you will need to show a loss, so have you had to have any remedial work done to make the work sound and safe?

Like you though I would be concerned at the manner of the recording of the complaint as believable without carrying out any investigation whatsoever. but I doubt there is anything further you can do about it.

Thank you - I have had the work redone not only was it a mess to look at I was concerned with safety - I live in a ground floor flat so must consider other residents as well as my own safety. I have contacted DBS to ask if I can access my file. It seems so wrong that the police assumed his story was correct - they did not contact me for my version - and had I not accessed the police report I would not have known he lied to the police making outrageous statements - like I was going to send my friends round. I have asked my MP for help. to be honest the police dont seem bothered he lied. There must be something I can do - otherwise this trader thinks he can do what he wants and have no come back. Any help would be good.

Does any of his documentation show a registration to any of the following? Niceic, Napit, Elecsa, Stroma, Bsi, ECS
if so you contact them and raise a complaint as that's what they are there for.
You could always enter his detail on here http://www.electricalcompetentperson.co.uk/search
which will tell you if he is registered or not if he isn't then you could try trading standards or building control if the work falls under the remit of Part P

Where you went wrong is that you continually contacted him, what you should have done is contacted him once and give him the opportunity to respond/rectify then failing that contacted his higher authority.
Can you give anymore detail of the work you were not happy with and why you thought it was dangerous?

Hi - I follwed advice given by CAB - I verbally informed him of my complaint - I have photographic evidence. I then e mailed him outling the complaint and suggesting a resoable resolution - he did not respond - I re-sent e mail 7 days later - he replied with an outgraeous e mail - I re-rrplied to him he replied to me - in total 5 e mails. My e mails outlined the complaint and suggested a resoanable resolution. Nothing threanting or harrassing in the content. I followed the adivce given by CAB - which is also I beleive what small claims courts insist happens prior to taking anyone to county court - which I beeive is an enactment of law.
