  • Capitol Commercial Collections

    Hi,
    I left ISS Ltd 22 May 2017, and had to chase up to receive my P45 and wage slips. I have now received a letter from Capitol Commercial Collections / The Corporate Consortium saying that I have been overpaid by nearly £200 and they insist that I pay it back within the next 14 days. Please can you advise, thank you.

    Have your ex employer previously informed you about the alleged overpayment, or is this CCC letter the first you have heard of it ?

      Hi, I have had no correspondence from my ex employer at all regarding this overpayment. I was owed holiday pay and just assumed that the extra money was that.

        I think you should write to your ex employer and ask them for a full detailed breakdown of the amount overpaid, how it came about and why you have heard nothing at all from them about any overpayment despite leaving in May and having communicated numerous times to get your P45 and wageslip. I'd also mention that you do not intend on communicating via any third party.

        did your P45 and wage slips correspond with the amount you got in your final pay ?

        could possibly also ask for copy of employment contract to check terms relating to overpayment etc.

          Thank you, I will do that. I received my P45 in the post and it was dated 28 June (my last working day was 18 May). I kept emailing my manager for my wage slip but no response. I emailed the ISS website in July and had a response from that. I was told to log onto the wage slip portal myself (even thought I had left) and print off the wage slip.
          I had no wage slip for May, two for June - my May wage on one of the June ones, and also a wage slip for July. One for June and July both had £0.00 for the pay. I will need to check the wage slip as I can't remember.

            I have checked my May wage slip that is dated 28/06/17. The final amount on it does not correspond with the amount that was paid into my bank account. I did not notice at the time as i did not manage to get my wage slip until July.

                Yes. I have had a friend who works in payroll to check what I am owed and she believes that I should only owe around £50

                  I suggest that you do need to contact your ex-employer as suggested by Amethyst in post 4. You need to get a breakdown from them as to what they believe the overpayment relates to. I would also double check the last 6 months that you were with your employer that the amounts on our payslips correspond to the deposit into your bank account.

                  I have to say that it is unusual for a company not to contact someone in the first instance to explain that an overpayment has been made and agree some repayment schedule.

                    Thank you. I have sent a letter today to my ex company. The 14 days set by CCC is up tomorrow so will wait and see if I receive another letter. Thank you for your help and advice.

                      Hi, hope you're well.
                      I sent a letter to my ex-employer 14 September saying that I would not deal with a third party and could they please give me an explanation on the wage query. I have not heard anything back yet. I have now received another letter (attached) from Capitol Commercial Collections. Are you able to advise me on what to do next please? Thank you.

                        I would ignore that letter , but send a copy of your 14th Sept letter to your ex employer reminding them they have not had the courtesy to respond, and you reiterate you will not deal through third parties.

                            I have sent two letters to my previous employer and have received no reply. I received this letter (attached) on Friday 17 Nov. Please can you advise what my next step should be. I am worried that I will be taken to court. Please help.

                              SD Worx seem to be a payroll management service - and this Capitol Commercial seem to be saying you owe SD worx for the overpayment rather than your actual employer ( ISS UK Ltd ). I'd do the same again tbh

                              Maybe you could post the letter you have sent to your exemployer and we'll have a see if we can strengthen it a bit to actually get an answer.
                              Otherwise I think you have made completely reasonable requests for clarification from your ex-employer on where/how this overpayment arose and they have completely ignored you. Capitol cannot bring court action themselves and it would have to be your employer who brought the action, not SD Worx either- guessing there may be some guarantee arrangement so if SD worx cock up wages they reimburse ISS then try claim it off the employee.... so as above I would write again to your employer saying you are dissapointed not to have received a response from them regards your previous letter and that should they bring court action against you you will defend and bring to the courts attention their complete lack of compliance with preaction protocols, state if there has been an overpayment you are happy to sort out a repayment however they have not explained where the overpayment has arisen.
