    I approached the Credit Services Association after a member, Drydensfairfax Solicitors kept asking me for money for their client, Max Recovery.

    I had raised some concerns that they had not shown any valid proof of debt, a notice of assignment they provided was invalid on a number of grounds, refusing to supply me with a copy of the original default notice, no valid credit agreement, and no termination notice either.

    The CSA accepted my complaint and have given Drydens 28 days to comply.

    So far they have not responded and have until 6th September to reply.

    So what happens if after the 28 days and still nothing from Drydens?

    Has anyone ever dealt with the CSA!?

    I have had dealings with the CSA over a member and you need to remember that they are a trade association and really have no teeth although I know they were part of one companies complaints procedures

    If I may say so, a lot of what you are asking for would be requirements for them to enforce in court and to be honest you are helping them by demanding they produce the documents because should they find them they will have a lot of what they then need.

    Few creditors hold copies of the original DN and I do not believe there is any requirement for them to produce it. In court they need to prove (on balance) a compliant one was sent.

    NOA - well really there is no specific requirement as to the form. The requirements are that when a debt is sold, either the old owner makes arrangements for you to be told as soon as is practical about new details unless there is no change in action you need to make.

    Again the termination notice is a legal enforcement

    I think you really need to let this go with Max recoveries, you are in danger of making it personal

    I do , I really do understand how lining your ducks up can help you feel in control but sometimes less is more
