  • Mileage Charge on VT query...

I know there has been lots of similar queries but I can't quite understand if they are the same situation as mine.
So my first question, I have just voluntarily terminated my mini agreement with BMW finance. I had paid over half etc & through the contract I changed jobs so my mileage did go over the 8000 pa that I was contracted to. They have worked out pro rata what I should've done & invoiced me for £299 it says payable under section 99 (2) of the consumer credit act. Is this correct? Do I have to pay excess mileage?

Second question, my initial miles on my contract says 6569 this is incorrect I have my delivery invoice & the miles stated are 9727 I have sent a photo of the agreement stating that they said on the phone they'll have to look into it to see if it's the truth. I don't know what to do if they don't believe this as all my other proof on the paperwork went back with the car.

thanks in advance for any help & advice.

If your delivery invoice says differently than the contract, then I would say you have a valid defence for not paying it.

I would suggest you read the following link as your starting point, there are some sample letters you can use if you wish to adapt to suit your situation.
